Official Contest Rules
THE CONTEST
1. Eagle Communications, Inc (d/b/a KSJQ St. Joe’s Q Country 92.7) (the “Station”) will conduct a contest (the “Contest”) for a chance to win a 2008 RIO-5 Kia – VIN#KNADE163X86326230 (the “Grand Prize”). The estimated retail value of the Grand Prize is $15,615.00. Only one Grand Prize will be awarded.
2. The Contest will begin on or about Monday, June 16, 2008 and end on or about Sunday, September 21, 2008 (the “Contest Period”).
3. No Purchase Necessary to enter or win the Contest. The Contest is void where prohibited. All federal, state and local laws and restrictions apply.
4. Odds of winning depend on total number of eligible entries received. Odds of becoming a Qualifier (defined below) through an on-air call in depend, in part, on the number of callers at the time the calls are solicited and the order in which the calls are answered. Odds of becoming a Qualifier through a Station entry event depend, in part, on the number of entries received at that particular event. Odds of becoming a Qualifier through mail-in entry depend, in part, on the total number of mail-in entries received. Odds of a Qualifier winning the Grand Prize depend on the total number of eligible Qualifiers who attend the Grand Prize Event (details below).
WHO CAN ENTER
5. To enter, contestants must be at least 21 years of age, legal residents of the States of Kansas, Missouri, Nebraska or Iowa and have a valid Kansas, Missouri, Nebraska or Iowa state driver’s license.
6. Employees (including, without limitation, part-time or temporary employees) of the Station, Contest sponsors (including, without limitation, Anderson Auto Group and/or registration locations) and any other St. Joseph area radio stations, and their respective parent entities, subsidiaries, affiliated companies and advertising and promotion agencies at any time during the applicable contesting period and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners and siblings) of each of the above are NOT eligible to enter and/or to win the Contest.
7. Persons who have won another contest or promotion of any kind from the Station within thirty (30) days before the Contest or prizes valued over $600 within six (6) months before the Contest are NOT eligible to enter and/or to win the Contest.
8. Eligible persons may enter the Contest as often as they wish but each individual may only become a Qualifier once during the Contest. Only one Qualifier per household.
HOW TO ENTER
9. Eligible persons can enter the Contest as follows:
a. Listen to Win: Listen to the Station between 6:00am and 11:59pm each day beginning on or about Monday, September 1, 2008 through on or about Thursday, September 18, 2008 for the Q Country Kia Key Sounder (“Sounder”). Immediately after the Sounder is played in its entirety (and not in a promotional announcement for the Contest) the seventh (7th) caller received on the Station’s contest lines ((816) 387-9927 will, subject to confirmation of eligibility, will be qualified to participate in the Grand Prize Car Giveaway Event (each a “Qualifier”)). Station may choose to play the Sounder and solicit calls multiple times each day, between Monday, September 1, 2008 through on or about Thursday, September 18, 2008.
b. Entry Blanks at Station Event(s): At various times during the Contest Period, listeners will be directed to multiple specific Station events. The location, date and times of each such event will be announced on-air. Persons may enter the Contest at such events. To enter, persons must complete an official entry blank and deposit it in the official entry box. Only official entry blanks are eligible (no mechanical reproductions will be accepted). At the end of each such event the Station will randomly select one (1) entry who will be qualified to participate in the Grand Prize Car Giveaway Event (each a “Qualifier”).
c. Mail-in Entry Forms: Listeners may also enter by mail. To enter in this manner, listeners must visit St. Joe’s Q Country 92.7, 4104 Country Lane, St. Joseph, MO 64506, obtain and complete an original printed entry blank and mail the completed entry blank to St. Joe’s Q Country 92.7, 4104 Country Lane, St. Joseph, MO 64506 by September 1, 2008 (the “Mail-in Deadline”). Such entries will only be accepted by first class United States mail and not by fax, hand delivery, overnight or same day courier. Only one entry is permitted per envelope (multiple entries within the same envelope will be disregarded). Mail-in entries must be legible and contain all information required. Only official entry blanks are eligible (no mechanical reproductions will be accepted).
HOW TO WIN
11. All Qualifiers will be invited to attend The Grand Prize Car Giveaway Event (the “Grand Prize Event”) for a chance to win the Grand Prize. The Grand Prize Event will take place during the Southside Fall Festival at Hyde Park in St. Joseph September 21, 2008.
12. In order to participate in the Grand Prize Event, Qualifiers must attend in person. Qualifiers must check in at The Q Country Check-In Table between 12noon and 2pm. Qualifiers must present a valid state-issued picture ID at check in. If a Qualifier has not checked in at The Q Country Check-In Table by 2:00pm, such Qualifier will be disqualified and their opportunity to participate in the Grand Prize Event shall be forfeited.
13. Each Qualifier will randomly draw a number and be given a wristband bearing that number. This number serves to designate the order in which each Qualifier will line-up to participate in the Grand Prize Event. Qualifiers will then, in ascending numerical order, draw a cd as their number is called. This cd will then be used to attempt to play a Q Country Jingle in the cd player of the Grand Prize. Each Qualifier will be given a chance to try their cd in the Grand Prize. If their cd does not play, they are not the winner and their participation in the Contest will be over. However, non-winning Qualifiers may choose to remain at the Grand Prize Event to participate in any random drawing that may take place (see immediately-following paragraph). Qualifiers will continue to try their cds and attempt to play in the cd player of the Grand Prize until one plays. The Qualifier that draws the first winning cd to play will win the Grand Prize (the “Winner”). There will only be one Winner.
14. If no Qualifier’s cd plays in the Grand Prize, then the Station will conduct a random drawing to select the Winner of the Grand Prize. All Qualifiers then present will be eligible to participate in the drawing. Any Qualifier who has departed the Grand Prize Event will forfeit their right to participate in the drawing.
16. State sales tax must be paid by the Winner in accordance with state law, based on the estimated retail value of the Grand Prize, as awarded. Contest participants are advised to contact their State Department of Revenue for actual tax rates and information. Winner will be responsible for any and all applicable federal, state and local taxes and or license fees arising from the receipt of any prizes in this contest and will be required to fill out the appropriate 1099 form, provided by The Station.
GENERAL RULES
17. Station shall not be responsible for any technical difficulties experienced due to overload, busy signals, loss of phone service, electronic problems or any other factor that may prevent an individual from completing a phone call or for any technical malfunction related to any telephone connection or any other technical problem that may impact entry including, without limitation, any internet telephone call connections.
18. Entries received by Station via the official entry boxes or via mail which are mutilated, tampered with, illegible, or from ineligible entrants will be void. Entries which are not completely deposited in the official entry box will be void. All entries become the property of the Station and will not be acknowledged or returned. Entries that are determined by Station to be fraudulent will be void and the person making such an entry barred from further participation in the Contest. Incomplete entries may be disqualified in Station’s sole discretion. Only official entry blanks are eligible (no mechanical reproductions will be accepted).
19. The Winner must sign a waiver of responsibility releasing: (i) Station, (ii) the parent entities, subsidiaries, affiliated companies of each of the foregoing, and (iii) and the shareholders, directors, members, managers, officers, agents and employees of each of the foregoing; from any and all claims, demands, or cause of action from participating in any aspect of the Contest, such Winner’s participation in the Contest, and from receipt of and or use of any prizes. In the event that the Winner refuses to sign the required release form, then such person will be disqualified and will not win any prize.
20. Winner shall be solely responsible for obtaining and payment of any federal or state required registration, inspection, insurance coverage, and taxes for the Grand Prize. Additional information regarding the warranty, pick-up/delivery, and additional information will be mailed to the winner within three weeks of winning the prize. Winner will be required to complete all relevant transfer documents for the Grand Prize at Anderson Auto Group in St. Joseph, MO during regular business hours. Neither Station or Anderson Auto Group has made or is responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to such vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer’s warranty that may apply to the vehicle. THE VEHICLE IS USED AND WILL BE ACCEPTED “AS IS”. The vehicle awarded will have been driven to Events and other Station and Sponsor events for promotional purposes.
23. By participating in the Contest, the Winner consents to the Station and its affiliates, employees, agents and all other related sponsors using for advertising and/or other promotional purposes, without additional compensation, such Winner’s, image, voice and/or biographical information on radio or TV broadcasts, newspaper advertisements and/or any other medium in connection with such Winner’s participation in the Contest. The Winner agrees that no additional compensation will be paid for such usage.
24. By participating in this Contest, each Qualifier gives permission and consents to Station’s recording and/or broadcasting such Qualifier’s name, voice, participation in the Contest, and the substance of the Qualifier’s telephone call. Each Qualifier agrees that no additional compensation will be paid for such usage.
25. Station accepts no responsibility of liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession and/or use of the Grand Prize.
26. The Grand Prize is not transferable or assignable. The Grand Prize is not redeemable for cash; provided that Station reserves the right to substitute a prize of equal or greater value (including a cash payment) for the Grand Prize.
27. Station reserves the right to: (i) terminate or declare the Contest null and void and rescind the Grand Prize, if in its sole judgment, the rules or the integrity of the Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a participant in the Contest; (ii) alter or amend these Contest rules at any time; and (iii) stop or conclude the Contest at any time without prior notice.
28. The Winner must present two forms of proper identification, one being a picture ID. Proper identification includes a state issued driver’s license, military ID, social security card or birth certificate. The Winner must provide the Station with their social security number in order to collect prize.
29. The Winner is responsible for paying all applicable local, county, state and federal taxes and registration fees on such Grand Prize based on the estimated retail value of such Grand Prize and will be issued a Form 1099
30. Station management shall be the sole arbiters in all matters relating to the Contest and the interpretation of these Contest rules. The decisions of Station shall be final. Contestant’s participation in the Contest constitutes agreement by such Contestant to abide by these rules. Station reserves the right to disqualify and remove any Contestant from the Contest at any time for any reason. If a Winner is found in violation of these rules or is otherwise disqualified by Station, then such Winner may be required by Station to forfeit the Grand Prize.
31. The Winner must claim the Grand Prize within 30 days of being awarded. In the event that a Winner fails to claim the Grand Prize within such 30-day period, such Winner shall forfeit the Grand Prize.
32. If the Grand Prize is forfeited under these rules, then it will remain the property of the Station and a new winner of such Grand Prize will not be selected.
33. Station reserves the right to change these rules without any prior notification and end the contest at any time with prior notification.
34. A complete copy of the rules are available at the Station’s studios 4104 Country Lane, St. Joseph, MO 64506 during normal business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday (excluding holidays). Any person may request a copy of these rules by sending a self addressed envelope to the Station at 4104 Country Lane, St. Joseph, MO 64506 attn: 2008 Q Country Car Giveaway Contest.
35. The name of any Winner will be available after the Grand Prize Event is completed by sending a self addressed stamped envelope to the Station at 4104 Country Lane, St. Joseph, MO 64506 attn: 2008 Q Country Car Giveaway Contest Winners List. Requests for Winners list must be received by the Station no later than four (4) months after the Contest has concluded.
36. Station’s general contest rules apply, except to the extent they are inconsistent with these rules.
